Terms of Service

These Terms of Service ("Terms") govern your use of Engagely (the "Service"), operated by 9Brainz ("we," "us," "our"). By creating an account, you agree to these Terms.

1. The Service

Engagely allows businesses ("Tenants," "you") to connect an Instagram Business or Creator account via Facebook and configure automated responses to comments and direct messages, using Meta's official Instagram Graph API.

2. Eligibility

You must be at least 18 years old and have the authority to connect the Facebook/Instagram account you use with the Service. You must own or have explicit authorization to manage any Instagram account you connect.

3. Your responsibilities

  • You are responsible for the content of any automated replies you configure.
  • You must comply with Meta's Platform Terms, Instagram's Terms of Use, and Community Guidelines at all times.
  • You must disclose to your audience, where required, that they are interacting with an automated system.
  • You may not use the Service to send spam, unsolicited bulk messages, or content that violates Meta's policies or applicable law.
  • You are responsible for maintaining the security of your account credentials.

4. Meta Platform compliance

The Service operates exclusively through Meta's official APIs. We reserve the right to suspend or terminate any automation rule or account that we believe violates Meta's Platform Policies, as continued violation risks the Instagram/Facebook access of all Tenants on the Service.

5. Subscription and billing

Currently, the Service is provided without an integrated payment gateway.

  • If we introduce plan tiers and billing in the future, we may change pricing with 30 days' notice to active Tenants.
  • Any future fees will be non-refundable except as required by law.

6. Data and privacy

Our collection and use of data is governed by our Privacy Policy, incorporated into these Terms by reference.

7. Service availability

We aim for high availability but do not guarantee uninterrupted access. The Service depends on Meta's APIs, and outages, rate limits, or policy changes on Meta's end may affect functionality outside our control.

8. Termination

You may cancel your account at any time. We may suspend or terminate accounts that violate these Terms, Meta's policies, or applicable law, with or without notice depending on severity.

9. Limitation of liability

To the maximum extent permitted by law, 9Brainz is not liable for indirect, incidental, or consequential damages arising from your use of the Service, including any action taken by Meta against your Instagram account.

10. Governing law

These Terms are governed by the laws of India, without regard to conflict of law principles.
